why not just ban smoking? I mean, this ruling prevents a company from advertising its own brand on its own packaging. That is just wrong, IMO. I am all for taking on big tobacco, but I think Australia is selling its soul a litte bit here.

The oz High Court has ruled that public health overrides trademark rights - but the difficulty for the Oz Gov is that Oz is a party to interntaional trade agreements which protect same - so that will have to be sorted out - but longer term it is "Mene mene tekel upharsin" for the weed.

it all depends on how much of revenue comes as a result of advertising the brand...very little i think...look at the drug trade...there is no advertising but there is a trade going on

take away advertising and it makes it a lot more difficult for new entrants into the market...

agree..but advertising lacks the actual aroma of tobacco and that you get from inhaling from your friends stub? Banning smoking in public places did more to dent the trade and making it illegal to smoke next to another individual will do more?
