Standard Bank Support Community Website- Terms & Conditions (Terms)


These Terms are an agreement between you as the user of the Standard Bank Support Community website and The Standard Bank of South Africa Limited (our/us/we). These Terms become effective when you use the Standard Bank Community Website (“website”). You must read and understand everything in these Terms and comply with these Terms as they are a binding agreement between you and us.

Important clauses, which may limit our responsibility or involve some risk for you, will be in bold. You must pay special attention to these clauses.


  1. ABOUT THE SUPPORT COMMUNITY

  2. 1.1 The Standard Bank Support Community (Support Community) is a website based forum where members may, subject to these Terms, discuss with one another in a free and open manner, any aspects regarding our products and services through sharing views and information, which may be viewed by both members and non-members of Support Community.

    1.2 While we want you to enjoy the experience of visiting the Support Community, we also want you to understand these Terms to which you agree when visiting and engaging on the Support Community.

  3. DEFINITIONS

  4. 2.1 “Applicable Laws” means all national, provincial, local and municipal legislation, regulations, statutes, by-laws, consents and/or other laws of any relevant governmental authority and any other instrument having the force of law as may be issued and in force from time to time relating to or connected with the activities contemplated under this Agreement, in particular including ECTA and POPI;

    2.2 "Best Industry Practice" means the exercise of such skill, diligence, prudence, foresight and judgement that would be expected from a highly skilled, experienced and reputed Person engaged in the provision of services similar to the Services at a world-class level;

    2.3 “Community” means the group of persons who have registered on the Standard Bank Support Community website, and who participate in and contribute to the community on the Website;

    2.4 “Cookie” means a small piece of data, that is stored by your Internet browser, the device you use to access the Website;

    2.5 “Data” means any data, namely quantities, characters or symbols on which operations are performed by a computer, which may be stored and transmitted in the form of electronic signals and recorded on magnetic, optical or mechanical recording media and shall include Personal Information as amplified if applicable by the definition thereof set out in the ECTA and the POPI Act and/or any Applicable Laws and/or equivalent legislation of the jurisdiction(s);

    2.6 “ECTA” means the Electronic Communications and Transactions Act 25 of 2002, as amended from time to time;

    2.7 “Group” means our affiliates, associates, subsidiaries and divisions together with our holding company;

    2.8 “Intellectual Property” means all trademarks, trade names, service marks, and trade dress, whether registered or unregistered, and all goodwill associated with such trademarks, trade names, service marks, and trade dress; patents and any designs or applications for the same; copyrights and copyrightable works (including drawings, designs, graphics, artworks, whether in physical form or in analogue or digital form, and all drafts or preliminary versions of any of the foregoing); rights protecting goodwill and reputation, know how, domain names and URLs; databases and database rights; graphics; schematics; marketing; sales and user data; topography rights; trade secrets, including confidential know-how, inventions, specifications, and processes; moral rights; computer software programs (in both source and object code form, and including any programmers’ or developers’ notes, flow charts, memoranda and design documents); application programming interfaces; protocols; and any renewal, extension, reissue, continuation, applications and/or registrations (whether pending or not) for any of the foregoing; and all rights or forms of protection of a similar nature to any of the foregoing or having equivalent effect anywhere in the world;

    2.9 “Intellectual Property Rights” means all rights in and to the Intellectual Property;

    2.10 “Personal Information” means information relating to an identifiable, natural or juristic person, including but not limited to, information relating to race, gender, sex, marital status, nationality, ethnic or social origin, colour, sexual orientation, age, physical or mental health, religion, belief, disability, language, birth, education, identity number, telephone number, email, postal or street address, biometric information and financial, criminal or employment history as well as correspondence sent by the person, that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;

    2.11 “POPI” means the Protection of Personal Information Act, 2013, as amended from time to time

    2.12 “Process” means any operation or activity, whether automated or not, concerning Personal Information, including: collection; receipt; recording; organization; collation; storage; updating or modification; retrieval; alteration; consultation; use; dissemination by means of transmission, distribution or making available in any other form; merging; linking as well as blocking; degradation; erasure, or destruction of information. Processing will have a similar meaning;

    2.13 “Standard Bank/our/us/we” means The Standard Bank of South Africa Limited (registration number: 1962/000738/06), a public company duly incorporated with limited liability according to the company laws of the Republic of South Africa;

    2.14 “Transaction” means the method of payment of a donation either by deposit at a branch or by electronic funds transfer from a donor into our bank account; and

    2.15 “Website” means the Internet website for the Standard Bank Community with the address https://community.standardbank.co.za and you/your means a user of this Website

  5. REGISTRATION, PROFILE CREATION AND SECURITY

  6. 3.1 By registering to become a member of the Support Community, you agree that we may use your Personal Information to contact you, about your profile or about any content you post in the Support Community and for other administrative purposes related to Support Community.

    3.2 When you register to become a Support Community member, you will be asked to choose an alias. An alias means a different name used to conceal your own identity when engaging on Support Community. Your alias must not be vulgar or violate the rights of others. We may reject, remove, suspend, edit, modify and/or moderate any content that you may post on your profile under your alias as set out in clause 4.7 below.

    3.3 You must only log onto Support Community using your alias and shall not use the alias of any other person.

    3.4 All information you share or post in Support Community, becomes part of Support Community, could form part of a conversation thread, and cannot be removed by you in your sole discretion. You agree to take this into account when considering the alias and any picture you use to represent yourself in Support Community or posting personal or non-public information in Support Community.

    3.5 You understand that individuals who are not our customers, who are also not members of Support Community, may view the information disclosed or posted by you in Support Community or on the Website. This means that certain “My Community Profile” settings may result in the information posted in Support Community or on the website being available to non-members of Support Community.

    3.6 You must take all necessary measures to safeguard your usernames, passwords and all other personal information. Personal information includes for example your account details, email address, PINS, Standard Bank account numbers and credit card information. Always keep this information completely private and please take care never to share it on Support Community. Standard Bank will never send you any email or other communication asking you to update or provide your Personal Information about you or your account. If you have any doubts about the legitimacy of an email or other communications you receive claiming to be from Standard Bank please forward them to [email protected].

    3.7 You hereby consent to your Personal Information being processed (in terms of the POPI and the website content shared by Standard Bank with other Support Community members and with third parties for the purpose of administering the Support Community and for the purposes set out in these Terms.

    3.9 You acknowledge and accept the risk, that a third party may post information on the Website, using your alias or remove your Personal Information for unlawful use. You agree not to hold us, or our affiliates, or any of our officers, directors, agents or employees liable for any cost or damages arising from such postings.

    3.10 You agree to immediately notify us of any unauthorised use of your Personal Information or alias, or any other breach of security.

  7. YOUR RESPONSIBILITIES WHEN USING THE SUPPORT COMMUNITY WEBSITE

  8. 4.1 The Website allows you to view content and contribute to the Community, and by your use you confirm that you have the necessary capacity and authority (where applicable) to use this Website. If you are younger than 18 you must have parental/guardian consent to use this Website.

    4.2 You may use the Website to browse the content, to contribute to the Community by asking banking related questions and providing reasonable comments to other Community members’ posts. You must not use this Website for any other purpose, including making false or fraudulent contributions to the Community.

    4.3 Content may be in the form of responses to blog posts, articles or stories, participation in forums or other discussion threads, replies to questions or the suggestion of ideas. If we allow you the opportunity to upload content to Support Community, please choose carefully the information that you post.

    4.4 You must use and update hardware and software (computer equipment and programmes) suitable for this Website. If you do not, the Website may not work properly and this could increase your security risks.

    4.5 You must not engage in any conduct or post any content, which is or which is likely to be:

    4.5.1 in breach of any Applicable Laws;

    4.5.2 in breach of the Intellectual Property rights or moral rights of any person or entity;

    4.5.3 in breach of any obligations of privacy or confidence in terms of POPI and ECTA;

    4.5.4 defamatory to any person;

    4.5.5 abusive, obscene, offensive, pornographic or indecent;

    4.5.6 harassing, threatening, insulting or vilifying of any person, for example based on race, religion, sexual orientation, gender, age or disability;

    4.5.7 affected by any virus or other code that is harmful, destructive, disabling or which assists in or enables theft or alteration of data; or

    4.5.8 false, misleading or deceptive.

    4.6 You must not do any of the following within Support Community:

    4.6.1 offer financial services of any kind;

    4.6.2 use Support Community for corporate or goods and services promotion or advertising of any kind;

    4.6.3 send or otherwise post unauthorised commercial communications;

    4.6.4 solicit, collect, copy, clone or store content, information or personal information belonging to other Support Community members, or otherwise access the website, using automated means or any other any means which you should reasonably know we would not intentionally make available to you through the website, without our prior written consent;

    4.6.5 upload or introduce any viruses or other computer-programming routines intended to damage, harm or interfere with Support Community or any system, software, hardware, telecommunications equipment, data, or personal information, or do anything that could disable or impair the proper working of the website;

    4.6.6 offer any contest, giveaway or sweepstakes;

    4.6.7 impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;

    4.6.8 change the topic of a thread to purposefully disrupt the flow of a conversation;

    4.6.9 forge headers or engage in manipulative practices designed to hide the origins or true intent of your submissions to the website, or to artificially generate traffic to another website;

    4.6.10 reproduce, duplicate, copy, publish, distribute, sell, resell, trade or exploit any of the content on the website without our prior written consent;

    4.6.11 post any content that is other people’s work and claim it as your own and not acknowledging or crediting the rightful author or source;

    4.6.12 facilitate, incite or encourage any breaches of these Terms; or

    4.6.13 post content to Support Community that violates or is not in compliance with our Terms.

    4.7 We reserve the right to immediately ban you from the Support Community Website and/or remove, suspend, edit , and/or moderate any content that you may post including in particular:

    4.7.1should you breach the provisions of clauses 4.5 and 4.6 above; and/or

    4.7.2notify law enforcement when we perceive a genuine risk of physical harm, or a direct threat of public safety. You may not credibly threaten others, or organise acts of real-world violence. Organisations with a record of terrorist or violent criminal activity are not allowed to maintain a presence on our site. We also prohibit promoting, planning or celebrating any of your actions if they have, or could, result in financial harm to others, including theft and vandalism; and/or

    4.7.3 take action against any abusive behaviour directed at other users or Community members, including but not limited to content targeting individuals or groups to attack others based on their race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability or medical condition; and/or

    4.7.4 we may remove graphic content that is of public interest or concern, such as human/animal rights abuses and any sexually explicit content.

    4.8 You must disclose any interest, conflict, or connection you have regarding any subject matter under discussion when making a post. For example, if you are employed by a company under discussion, or receive a benefit, you must disclose this.

  9. OUR RIGHTS AND LIMITATION OF OUR LIABILITY

  10. 5.1 You acknowledge and agree that we are not responsible or liable for the deletion or failure to store any content or messages posted by you or any other person on the Support Community Website.

    5.2 We shall not in any way be liable to you or any other person for any modification, suspension or discontinuance of the Support Community Website.

    5.3 You acknowledge and agree that by accessing the Website and participating in Support Community, you may receive material that you may consider to be in breach of clause 4.5 above and does not reflect our views.

    5.4 You acknowledge that certain factors may be beyond our control, such as the network covered or your internet service provider’s availability.

    5.5 You acknowledge and agree that under no circumstances will you hold us, or any of our affiliates, or respective officers, directors, agents, shareholders and employees liable, for any content posted on the Website or for any loss or damage, of any kind, incurred as a result of your use of the Website, participation in Support Community or reliance on any of the information or content.

    5.6 You agree not to access Support Community by any means other than through the interfaces that are provided or approved in writing by us.

  11. TERMINATION

  12. 6.1 We reserve the right and may in our sole discretion, at any time, modify, suspend or discontinue the Support Community Website, temporarily or permanently, at any time without notice to you. We may also limit certain services, feature or functions on the Support Community Website and we may restrict access to all or parts of any service on the Website.

    6.2 If your participation in the Support Community is suspended or terminated by us, we may terminate your access to all your prior postings and settings. While we will continue to honour your Support Community privacy settings, we may, but are not obliged to, delete posts and other information disclosed as of the time your participation in Support Community ended.

    Upon termination, your postings may, at our sole discretion, remain part of and available to the Support Community. We have no obligation to you or any other Support Community member to preserve any information or content you or any other member of Support Community has posted on the website for any period of time.

  13. IMPORTANT INFORMATION

  14. 7.1 When using Support Community, you must be aware of the following:

    7.1.1 The views expressed within Support Community are not our views. We do not vouch for the accuracy or authenticity of posts;

    7.1.2 Posts are not professional advice and must not be treated as such, even if they are directed to you. Posts are general information only and you must carefully consider any decisions you make based on Support Community content. We are not responsible for any loss you may suffer as a result of relying on Support Community content for any reason;

    7.1.3 You acknowledge and agree that the content posted on the website has been prepared without taking into account your personal objectives, financial situation or needs;

    7.1.4 From time to time our staff may participate in the Support Community as customers. In doing so, our staff members are acting in their personal capacity and are not acting as an employee, adviser, representative or agent of us and these staff members bear all responsibility for the content of their posts.

    7.1.5 When our staff members do post as representatives of us, then such staff member will be identified as such by the depiction of the our logo.

    7.1.6 These Terms are governed by South African Law and all Data Protection and Consumer Protection laws thereunder will apply.

    7.2 You are personally responsible for the content of your posts. You must not include misleading or deceptive information in your posts or use Support Community Website to engage in illegal or unauthorised activity;

    7.3 You must always report to us any posts which you suspect are inaccurate or may mislead or deceive other Support Community members. This includes posts which contain information that might, over time, be no longer accurate. If you become aware of the misuse of Support Community Website or its features by any person, please click on the “Report Inappropriate Content” link on the Support Community page and follow the directions,

  15. PRIVACY NOTE AND INTELLECTUAL PROPERTY

  16. 8.1 We may collect and you expressly consent to the collecting and Processing of your Personal information:

    8.1.1 to open, administer and operate your use of the Website;

    8.1.2 to carry out statistical and other analyses to identify potential markets and trends, evaluate and improve our business (this includes improving existing and developing new products and services);

    8.1.3 where services are provided outside of the Republic of South Africa (‘the country”), these countries may not have the same data protection laws. Where we can, we will ask the receiving party to agree to our privacy policies;

    8.1.4 where sharing your Personal Information with our third-party service providers and insurers locally and outside the country where the products or services are provided. We ask people who provide services to us, including our insurers, to agree to our privacy policies if they need access to any Personal Information to carry out their obligations; and

    8.1.5 within our group.

    8.2 You hereby consent that we may:

    8.2.1 process your Personal Information within our group for the above purposes; and

    8.2.2 share your Personal Information with our service providers, locally and outside South Africa, as necessary. Our service providers must agree to our privacy policies before we give them any Personal Information so that they can carry out their services.

    8.3 You acknowledge that:

    8.3.1 we will at all times remain responsible for determining the purpose of and means we are required by various laws to collect some of your Personal Information;

    8.3.2 without your personal information, we may be unable to offer the goods or services to you; and

    8.3.3 you are providing us with your Personal Information voluntarily.

    8.4 Any Personal Information received by us will be stored on a secure server.

    8.5 We will disclose Personal Information, if required by law.

    8.6 You are aware that information sent over the internet can be intercepted, seen or changed, despite our best efforts to protect you against this, and you agree that we will not be responsible for any loss or damage you may suffer as a result.

    8.7 You acknowledge that we own all rights, including, but not limited to, Intellectual Property Rights, title and interest in all the Intellectual Property contained or referred to on the Website except if we say differently elsewhere;

    8.8 You agree that you:

    8.8.1 will in no way represent that you have any rights of any nature in our current and future Intellectual Property;

    8.8.2 will not use our current and future Intellectual Property in any manner whatsoever, or any other Intellectual Property which is identical, similar and/or confusingly similar in any country;

    8.8.3 will not apply for or obtain registration of our current and future Intellectual Property or any other Intellectual Property which may be confusingly similar in any country;

    8.8.4 will not challenge our rights to our current and future Intellectual Property in any country;

    8.8.5 will not do, or fail to do, or cause to be done any act or thing which may weaken, damage, be detrimental to or in any way impair or tend to impair our current and future Intellectual Property or the reputation and goodwill associated with our Intellectual Property or us, or which may jeopardise or invalidate any registration of our current and future Intellectual Property; and

    8.8.6 will not use, register or attempt to register as trade names, corporate names, business names, logos, domain names, meta-tags, meta descriptors, electronic mail (e-mail) addresses, server names, search-engine markers or anything that is identical to, contained in whole or in part, or is otherwise confusingly similar to our current and future Intellectual Property in any country,

    8.9 You agree that you will not establish an iframe, metatag, similar reference, whether electronically or otherwise (together referred to as linking), or any other reference, to the Website. You may establish a hyperlink, provided you obtain our consent and approval for the hyperlink first.

    8.10 We keep all Intellectual Property Rights in all content published on or through our Website, including but not limited to all proprietary information, trademarks and copyright in any logos and other graphics devices or storage media, and you may print and make paper copies of it only if:

    8.10.1 it is for using or deciding about our products and services, or your donation; and

    8.10.2 you do so knowing that the logos and trademarks on our Website are our registered and unregistered trademarks or belong to other parties. Nothing on our Website gives you permission (licence) or right to use any trademark or any other Intellectual Property for any other purpose. Even if any content on our Website is not confidential or there is no copyright in it, we own all of it and you have no rights in it.

    8.10.3 You may not use our Intellectual Property or that of a third party on our Website without our prior written permission.

    8.11 This Website and the content on it may not be copied, republished, posted, or distributed in any way.

    8.12 Unauthorised use of this Website and/or the materials contained on this Website may violate applicable copyright, trademark or intellectual property laws or other laws.

    8.13 You indemnify us against all claims, costs, demands and other liabilities suffered or incurred by us, as a result of any third party claims against us, relating to your unauthorised use of our current and future Intellectual Property

    8.14 If you breach of these Terms we may, in addition to our normal common law remedies, take legal action without notice to you, and you agree to reimburse us the costs associated with such legal action on an attorney and own client scale.

    8.15 By displaying, publishing or uploading any content in Support Community Website or otherwise submitting or posting content to us, you grant us an irrevocable, perpetual, worldwide, royalty-free and non-exclusive licence (including the right to sub-license that content to any person or entity) to use, modify, delete, add, store, create derivative works of, publicly perform, publicly display, reproduce and distribute the content in or through Support Community for any reason (including advertising and promoting Support Community and/or our products and services).

    8.16 You represent and warrant that:

    8.16.1 You own the content you post or otherwise have the right to grant the licences above;

    8.16.2 You have not infringed the intellectual property or privacy rights of any person or entity.

    8.17 Support Community website contains content provided by us (including third party content posted or displayed by us); and

    8.18 We and/or the third parties we have engaged own and retain all rights in that content.

  17. DISCLAIMERS, LIABILITY AND INDEMNITIES

  18. 9.1 You expressly agree that the use of the Support Community Website is entirely at your own risk.

    9.2 We are not responsible for the conduct, whether online or offline, of any member of Support Community. You should do your own research and think carefully before acting on any information contained in Support Community or any linked website. If you have any concerns, you should seek your own financial, legal or taxation advice.

    9.3 We provide our services together with third party services and as such a number of features of the Support Community may be offered or processed through a third party service provider, which is not associated or affiliated with us, or any of our related bodies corporate. Unless otherwise noted, all authority granted to us, or limitations of liability to us, shall include our affiliates, agents and representatives and any service provider.

    9.4 We are not responsible for the validity of such external sites or resources, we do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or content (including misrepresentative or defamatory content) of such websites, including (without limitation) any advertising products or other material or services on or available from such websites or resources. Independent suppliers supply goods and/or services offered on this Website. These are covered by supplier warranties. These warranties must be completed and submitted to suppliers, by you, to validate the warranty. We make no guarantees, warranties or representations of any kind, expressed or implied, with regards to the goods or services supplied by independent service providers. We will not be liable for any inconvenience or losses that may arise in or from the use of the goods or services by you, provided by independent service providers.

    9.5 We do not warrant that the functions provided by the Support Community Website will be uninterrupted or error free, or that the Support Community Website or the server that makes it available is free from viruses or other harmful components. Note: we highly recommend that you use industry-endorsed anti-virus, anti-spam and anti-phishing software to make your online experience less disruptive.

    9.6 To the extent permitted by law, in no event shall we be liable for any damage, claim or loss incurred by you in connection with or arising from your use of Support Community, including without limitation compensatory, incidental, direct, indirect, special, consequential damages, irrespective of whether we have been informed of, knew of, or should have known of the likelihood of such damages.

    9.7 You agree to indemnify and hold us, and our respective officers, agents, partners and employees, harmless from any loss, liability, cost, expense, claim, or demand, including without limitation, reasonable legal fees, due or relating to or arising out of your use of Support Community in violation of these Terms and/or arising from a breach of these Terms and/or any breach of your representations and warranties set forth in these Terms and/or arising out of or relating to any content that you post.
